Pay inequality has been illegal since President Kennedy signed the Equal Pay Act in 1963. Vermont outlawed pay discrimination in the Fair Employment Act that same year. Nationally, women earn roughly 78 percent of what their male counterparts earn. In Vermont, women earn roughly 84 cents per dollar earned by men. Effective July 1, 2013, it is unlawful to discriminate on the basis of sex by paying wages to employees of one

sex at a rate less than that paid to employees of the other sex for work that requires equal skill, effort, responsibility, and is performed under similar working conditions. It is also unlawful for any Vermont employer, employment agency, labor organization or person seeking employees to discriminate except where a bona fide occupational qualification requires persons of a particular race, color, religion, national origin, sex, sexual orientation, gender identity, ancestry, place of birth, age, or physical or mental condition.

The Vermont Equal Pay Act (H.99) also outlines unlawful discharge or discrimination against an employee from employment due to an attempt to assert a claim for benefits under this Act. All Vermont employers are recommended to post a notice with information regarding equal pay and unlawful employment practices.
