All businesses that conduct background investigations on job applicants or credit checks on customers must comply with the notification and identify theft provisions of the Fair Credit Reporting Act (FCRA). Under the FCRA, businesses are obligated to obtain a written authorization from an applicant or employee before a background investigation, obtain authorization from customers prior to a credit check, provide a “Summary of Consumer Rights” notice if a background check or credit check results in adverse action, and ensure that personally identifiable documents are shredded to prevent identity theft. (An “adverse action” is defined as “failure to hire, promote, or transfer an applicant or employee” or “failure to grant credit, insurance, or housing to a consumer.”)
Effective September 21, 2018, businesses must begin using a revised “Summary of Consumer Rights” notice to comply with the FCRA. The revised notice is published and enforced by the Consumer Financial Protection Bureau (CFPB), and now includes information on security freezes that can protect an individual’s credit rating from being damaged by identity theft. Violations of FCRA notice requirements can result in penalties up to $3,756 per violation.
