Under the Fair Credit Reporting Act (FCRA), before performing a background check, the employer has to notify the applicant in writing, explaining that the results of the background check will be used for purposes including hiring, promoting, or retention.  The applicant must provide written acknowledgment that they received the notice, and provide their consent to undergo the background investigation as a condition of employment if the background check is being performed by a third party.   Failure to comply with FCRA requirements can result in fines and penalties.
