Under the Immigration Reform and Control Act (IRCA), employers with four or more employees are prohibited from discriminating against employees and job applicants on the basis of citizenship or national origin. In addition, IRCA prohibits the hiring and continued employment of undocumented aliens who are not authorized to work in the United States. Under IRCA, all employers are required to verify work authorization and identity of all employees through the use of Form I-9 within three days of hire.Failure to comply with the provisions of the IRCA and related I-9 regulations can result in employee lawsuits and fines ranging from $230 to $2,292 per individual, depending on the type and severity of the violation.
