The Consolidated Omnibus Budget Reconciliation Act (COBRA) and state COBRA laws require covered employers to offer continuation of health benefits when a qualifying event occurs. Qualifying events include:

  • the death of the covered employee;
  • a covered employee's termination of employment or reduction of the hours of employment;
  • the covered employee becoming entitled to Medicare;
  • divorce or legal separation from the covered employee; or
  • a dependent child ceasing to be a dependent under the generally applicable requirements of the plan.

 Under COBRA, employers must provide a general notice explaining COBRA continuation coverage to employee health plan participants and provide additional notices to terminated workers regarding eligibility and election of coverage options. Failure to comply with COBRA notice requirements can result in penalties of $110 per violation per day.
