The federal Family and Medical Leave Act of 1993 (FMLA) provides eligible employees with up to 12 weeks of job protected leave for the treatment of a serious health condition, the adoption or birth of a child, or to care for a seriously ill family member. All employers with 50 or more employees within a 75-mile radius, and all elementary and secondary schools regardless of number of employees, are covered by the FMLA.
The U.S. Department of Labor (DOL) has released revised FMLA regulations that expand and clarify employer obligations under the FMLA. The new final rules clarify intermittent FMLA usage, add provisions relating to military caregiver leave and qualifying exigency leave, and introduce newly revised FMLA documentation forms. FMLA leave has also been extended to flight crew members.
To comply with the FMLA and its newly revised regulations, all covered employers must post the newly revised FMLA poster, update their family/medical leave policies, implement new documentation forms released by the DOL, and comply with revised notice requirements.Failure to do so can leave your business vulnerable to employee lawsuits and DOL enforcement actions, including payment of penalties, interest and liquidated damages. To help covered employers ensure their compliance with new and existing FMLA requirements, Personnel Concepts has introduced an updated FMLA Compliance Program.
The new edition includes a 100-page plain-language reference manual, legal briefs from two attorneys on the recent updates and common FMLA mistakes, reproducible documentation forms and notices, a CD-ROM with fill-in-theblank forms and customizable policies, and an All-On-One FMLA Information Poster. This exclusive program includes all of the tools and information you need to ensure your compliance with the FMLA, including all the new regulations.
Who Needs It
The FMLA applies to all private employers with 50 or more employees within a 75-mile radius, all secondary and elementary schools, and all public agencies. All FMLAcovered establishments must comply with notification, documentation, and administration requirements under revised regulations.
Compliance Made Simple
Posting our All-On-One FMLA Poster, implementing the new and revised documentation forms into your FMLA administration process, and reading the legal briefs in the manual will help you meet your obligations under the DOL’s revised final regulations and protect you in the event of a DOL investigation.
Prevent Costly Lawsuits
FMLA-related employee lawsuits alleging retaliation, wrongful termination, or refusal to grant job-protected leave to eligible individuals can result in costly judgments requiring payment of liquidated damages, attorney’s fees, lost wages, and interest. Our FMLA Compliance Program includes the information and documentation forms you need to ensure that employees and managers know their rights and obligations under the law.
