All employers must notify past, present, and future members of the uniformed services in writing about their rights and obligations under USERRA. Failure to abide by the provisions of USERRA including notice and anti-discrimination rules, can result in enforcement action against your company by the Veterans Employment and Training Service (VETS), and the U.S. Department of Labor. Penalties for non-compliance include prosecution, judgments for back wages, and liquidated damages, and other potential penalities. Under USERRA, employers are prohibited from discriminating against veterans, inactive members of the Guard and Reserves, or employees who decide to enlist in the uniformed services.
