Regulatory Requirements

Every employer performing work covered by the Walsh-Healey Public Contracts Act or the McNamara-O'Hara Service Contract Act (SCA) is required to post a notice regarding compensation requirements.

Required for general contractors and subcontractors that have government contracts in excess $2,500 and for manufacturing contractors who handle or ship goods under contracts exceeding $10,000.

Failure to comply with the posting requirements or implementing regulations may result in the termination of the contract and possible debarment from future government contracts for a period of up to three years.

Every employer performing work covered by the Walsh-Healey Public Contracts Act or the McNamara-O'Hara Service Contract Act (SCA) is required to post a notice of the compensation required (the Employee Rights in Government Contracts Poster) in a prominent and accessible location at the worksite where it may be seen by all employees performing on the contract.
The Walsh-Healey Public Contracts Act (PCA) requires contractors engaged in the manufacturing or furnishing of materials, supplies, articles, or equipment to the U.S. government or the District of Columbia to pay employees who produce, assemble, handle, or ship goods under contracts exceeding $10,000, the federal minimum wage for all hours worked and time and one half their regular rate of pay for all hours worked over 40 in a workweek.
 
The McNamara-O'Hara Service Contract Act (SCA) requires contractors and subcontractors performing services on covered federal or District of Columbia contracts in excess of $2,500 to pay service employees in various classes no less than the monetary wage rates and to furnish fringe benefits.
 
Covered employers under either the PCA or the SCA can use our laminated poster to communicate these rights to their employees and to satisfy posting requirements under the Acts. Failure to comply with the posting requirements or implementing regulations may result in the termination of the contract, in addition to holding the contractor liable for associated costs to the government and possible debarment from future government contracts for a period of up to three years.
