Regulatory Requirements

The Occupational Safety and Health Act (OSH Act) and related OSHA safety regulations require employers to conspicuously post required safety information in the workplace and provide notification to employees about safe work practices and common workplace hazards. Posting and notification obligations for most general industry employers are summarized below.

OSHA 3165-09R “It’s the Law” Poster (29 CFR 1903.2) – Every employer subject to the Act must conspicuously display the OSHA “It’s the Law” poster or a state equivalent in each area where separate work activities are performed.

Access to Medical and Exposure Records (29 CFR 1910.1020(g)) – Employers must notify their employees at least annually in writing of their right to obtain access to any medical or exposure records that are created or stored on company premises. Posting this notice meets the requirement.

Emergency Phone Numbers (29 CFR 1910.165(b)(4)) – The employer shall post emergency telephone numbers near telephones, or employee notice boards, and other conspicuous locations when telephones serve as a means of reporting emergencies.

Injury & Illness Reporting Procedures (29 CFR 1904.3) – Employers must ensure that employees are notified of the proper procedure for immediately reporting a work-related injury or illness.

OSHA 300-A Summary (29 CFR 1904.32) – Covered employers must conspicuously display a summary of the prior year’s occupational injuries and illnesses. This summary must be posted from February 1st thru April 30th.

Personal Protective Equipment (PPE) Notice (29 CFR 1910.32(f)(1)) – Employers must identify and select personal protective equipment (PPE) to protect workers from injury, and must communicate their PPE selections to all employees.

Accident Prevention Signs (29 CFR 1910.145) - All employees shall be instructed that danger signs indicate immediate danger and that special precautions are necessary, and that caution signs indicate a possible hazard against which proper precaution should be taken.

All employers, regardless of industry type or size of business, must communicate pertinent safety information to their employees in accordance with OSHA standards. The easiest, most effective way to comply with mandatory safety notification requirements is to post notices informing employees about safe work practices, safety equipment, and injury reporting procedures. Failure to comply with OSHA standards, including notification and posting requirements, can result in fines up to $7,000.00.
