Personnel Concepts Launches FCRA Compliance Kit

ONTARIO, Calif.—Commencing Jan. 1, 2013, all employers conducting consumer background checks on job applicants or employees must issue a revised Summary of Consumer Rights to the affected individuals. To help employers comply with the new requirement, Personnel Concepts has issued a FCRA Compliance Kit.

FCRA refers to the Fair Credit Reporting Act, which previously was enforced by the Federal Trade Commission (FTC). Since this enforcement authority will pass to the newly formed Consumer Financial Protection Board (CFPB), the summary had to be updated to reflect the new reality.

Failure to follow the FCRA in conducting background credit checks can result in fines of up to $2,500 per violation.

“Both the states and federal government are watching consumer credit checks and their use in employment decisions more closely than ever,” said Robert Leland, director of research for Personnel Concepts. “With our FCRA Compliance Kit, employers will be better able to navigate the tricky waters of compliance and keep legal action at bay.”

NLRB Publishes Regulation Mandating All Employers to Post NLRA Rights Notice

With the publication today of a new National Labor Relations Board (NLRB) regulation requiring all employers to post a National Labor Relations Act (NLRA) notification for easy access by their employees, Personnel Concepts has moved quickly to publish a text- and size-compliant poster and make it available to businesses everywhere.

The 11-by-17 poster contains the exactly wording that will be used in today's Federal Register-published regulation. The Personnel Concepts research department painstakingly verified the accuracy and compliance of the poster through direct contact with the NLRB.
