NLRB Publishes Regulation Mandating All Employers to Post NLRA Rights Notice

With the publication today of a new National Labor Relations Board (NLRB) regulation requiring all employers to post a National Labor Relations Act (NLRA) notification for easy access by their employees, Personnel Concepts has moved quickly to publish a text- and size-compliant poster and make it available to businesses everywhere.

WHD's Decision to Quit Issuing Opinion Letters Could Make Life Harder for the Nation's Businesses

 ONTARIO, Calif.—The issuance of an Administrative Interpretation (AI) by the Wage and Hour Division (WHD) of the Department of Labor (DOL) this past week on the status of mortgage loan officers signals a new approach by the nation’s workplace watchdogs, one that could make life more challenging for business owners, warns Personnel Concepts.

This AI concluded that the Fair Labor Standards Act’s administrative exemption does not apply to mortgage loan officers and that they are thus non-exempt employees eligible for overtime wages. Along with the issuance of the AI, the agency also announced it was dropping the practice of issuing individualized opinion letters.

"In the past employers would often rely on opinion letters regarding specific wage and hour situations under the FLSA,” said Robert Leland, director of research for Personnel Concepts, “but in dropping opinion letters in favor of more generalized Administrative Interpretations, WHD has choked off individual guidance, leaving employers with one less resource and potential line of defense.”

In fact, the AI actually overruled a previous opinion letter on mortgage loan officers. The decision to quit issuing such letters also left some 400 current enquiries unanswered.

According to legal observers, opinion letters have often served as a first-line defense under the Portal-to-Portal Act, which holds that good-faith reliance on a “written administrative regulation, order, ruling, approval, or interpretation” relieves the company of liability.

Health Care Reform to Affect Businesses Differently, Depending on Size

ONTARIO, Calif.—With the passage of the Patient Protection and Affordable Care Act, a timeline of health insurance cost and accessibility changes has been set in motion, affecting employers in different ways depending on their size and composition, according to an analysis by Personnel Concepts, pacesetter and pioneer in the labor law poster compliance industry.

Leaving aside the question of how the bill affects health insurance companies (which stand to gain from the legislation with millions of new subscribers from the individual mandate), how does the passage of the act on March 21, 2010, affect the nation’s employers? 

Details may change as the reconciliation process attempts to merge the House and Senate bills more fully than the one President Obama signed on March 23, but the overall thrust and structure will not. Here’s the basic answer:

Three salient points emerge. The first is that, technically speaking, there is no employer mandate to provide health insurance for one’s employees. Second, the “play or pay” rule that substitutes for the employer mandate affects only businesses with an average of 50 or more full-time (30 hours a week) employees. The third and final point is that most of this doesn’t even take effect until after Dec. 31, 2013.

On the small business front, the bill does provide subsidies, starting immediately, for firms to offer insurance to their employees. Here the details may change with reconciliation, but the subsidies will continue even after the full individual mandate and “play or pay” provisions take hold in 2014. Contingent on meeting certain qualifications, as things stand now there will be at least a 35 percent small business subsidy through the end of 2013, and a 50 percent subsidy after that (indexed to inflation).

Starting in 2014, an “applicable larger employer” (more than 50 full-timers) that does not offer coverage for all its full-time employees, or offers minimum essential coverage that is unaffordable, or offers a plan that pays less than 60 percent of the cost of benefits will be required to pay a penalty. The penalty kicks in once a single employee purchases a plan with a government subsidy. The penalty as it stands now is $2,000 for every employee above a 30-employee threshold. (Reconciliation may lower the penalty to $750 with the same threshold.)

Business groups have speculated that many firms will game the system by, for instance, reducing full-time staff from above 50 to below 50 (making some employees part-time,  laying off others), or by dropping health insurance altogether and just paying the fine. This all remains to be seen, and the success and failure of the overall reform measure may well hang in the balance.

Of course, many other measures will kick in between now and 2014, but most affect insurance companies and insurance plans, which in turn, of course, affect businesses that offer health benefits. Here, for example, is the requirement that plans include coverage for dependents up to the age of 26 beginning in six months.

Employers Need to Update Their Labor Law Posters for the New GINA-EEOC Panel

ONTARIO, Calif.—The Genetic Information Nondiscrimination Act (GINA) takes effect for employers with 15 or more on staff Nov. 21, and the Equal Employment Opportunity Commission (EEOC) has already revised its mandatory “Equal Employment Opportunity is the Law” poster to reflect GINA regulations, Personnel Concepts advises.

The new poster, which has already been incorporated into Personnel Concepts’ Space Saver-1 All-On-One State and Federal Labor Law Poster series, also promulgates new regulations for the Americans With Disabilities Amendments Act (ADAAA).

Current holders of the SS-1 Labor Law Poster must replace their EEOC panel with the November 2009 version. Update subscribers will automatically be mailed the replacement panels. Colorado Updates Its Unemployment Benefits Labor Law Poster

ONTARIO, Calif.—Colorado has updated its mandatory unemployment benefits poster, which is included on Personnel Concepts’ Colorado All-On-One State and Federal Labor Law Poster, the California-based labor law poster compliance company advises employers in Colorado.

The changes reflect increased enforcement of the proper classification of workers as exempt from overtime pay and non-exempt and thus overtime pay eligible. Fines for offenses have been increased to $5,000 per incident. The poster also provides information and telephone numbers for employees to lodge complaints.

Current holders of Personnel Concepts’ Colorado Space Saver-1 All-On-One State and Federal Labor Law poster will be advised of the availability of the new poster via mail, and update subscription customers will automatically be mailed a replacement panel to update their current labor law posters.
