California's Safe Drinking Water and Toxic Enforcement Act (commonly referred to as "Prop 65") has been a source of controversy and employer confusion since its enactment in 1986. While most employers are familiar with high-end restrictions on discharging chemicals into drinking water, many employers are not aware of the regulation's "clear and reasonable warning" posting requirements that apply to any California business who has (or has ever had) 10 or more employees on payroll.

Under Prop 65, covered employers must warn any individual on the business premises if there are any chemicals present that cause cancer, birth defects, or reproductive harm.

California Health & Safety Code Sec. 25249.7 states that any business owner who doesn't give their customers, employees and the general public clear and reasonable warning can be subject to fines up to $2,500 per day per violation.

Consumers, employees, and government agencies have served California businesses in virtually every industry group with 60-day notices for Prop 65 warning violations.
