All employers who use or store any hazardous chemicals in the workplace must comply with OSHA’s Hazard Communication Standard (29 CFR 1910.1200). This regulation, which has regularly topped OSHA’s list of the most frequently cited standards, requires covered employers to implement and maintain a written Hazard Communication Program (1910.1200(e)). The written program must address employee training on chemical hazards, a list of hazardous chemicals, instructions on how to obtain and store chemical safety data sheets, and an explanation of how chemical labels and other forms of warning will be used in the workplace. Failure to comply with OSHA’s Hazard Communication Standard can result in fines up to $7,000 per violation. Maximum fines for noncompliance will be increasing by up to 80% on or before Aug. 1, 2016.

By the final compliance deadline of June 1, 2016, all covered employers must update their written hazard communication programs to reflect the U.N’s globally harmonized system (GHS) of chemical labeling and identification. This employer deadline represents the final implementation of OSHA’s revised standard, which took effect in May 2012. Prior to the final June 2016 deadline, employers, chemical manufacturers, and chemical distributors had to comply with other compliance deadlines pertaining to labeling, safety data sheets, and employee training.
