The Fair Labor Standards Act (FLSA) of 1938, as updated by the FairPay Overtime Rules of 2004, subjects companies to several tests based on salary and duties to determine whether an employee can be classified as "exempt" and thus not be subject to an overtime pay premium.

The salary test is simple: The person must be paid $455 a week for however long he or she works. The duties test involves employees in executive, administrative and professional categories and can be more complicated and cumbersome.
