Sec. 541.603 (d) of the FairPay Overtime Rules requires employers who employ exempt salaried workers to implement a salary deductions policy that includes a listing of the permissible reasons for salary deductions, guidelines on how to report improper deductions, and a statement of how the employer will correct reported errors.

Failure to implement a policy that meets the requirements of Sec. 541.603(d) can result in the loss of exempt status for an entire group of employees, overtime lawsuits, back wages, and other penalties in the event of an improper salary deduction.
