The CHIPRA Compliance Poster will fulfill the new notice requirements that apply to all businesses that offer health benefits to employees. Under the Children’s Health Insurance Program Reauthorization Act (CHIPRA), employees in 38 states are entitled to apply for health premium assistance for themselves and their dependants via state Medicaid and children’s health programs.

CHIPRA requires employers to provide a notice informing employee health plan participants of their right to apply for such assistance and whom to contact within their state for more information.

Compliance Deadlines:

► May 1, 2010 for group health plans that begin between Feb. 4, 2010, and May 1, 2010

► Jan. 1, 2011 for all other group health plans (calendar plans beginning after May 1, 2010)

Who Needs It
All businesses that offer health insurance in one of the 38 states that have enacted state child health care programs to assist employees with health premiums.*

(*The states that do not participate in CHIPRA are AR, CA, CT, DE, HI, IL, MD, MI, MS, NM, OH, and TN. DC and PR also don't participate.)

Penalties for Non-Compliance
Failure to comply with CHIPRA notice requirements can result in penalties of up to $110 per violation per day. A 30-day violation could result in a $3,330 penalty for each covered employee who was not provided the notice.
