The federal Family and Medical Leave Act of 1993 (FMLA) provides eligible employees with up to 12 weeks of job-protected leave for the treatment of a serious health condition, the adoption or birth of a child, or caring for a seriously ill family member. All employers with 50 or more employees within a 75-mile radius, and all elementary and secondary schools, are covered by the FMLA.

The U.S. Department of Labor (DOL) has released revised FMLA regulations effective January 16th, 2009 that expand and clarify employer obligations under the FMLA. The new final rules specifically clarify notice and certification obligations, introduce newly revised FMLA documentation forms, and include new military family leave provisions mandated by a recent amendment. Failure to comply with FMLA requirements can leave your business vulnerable to employee lawsuits and DOL enforcement actions, including payment of penalties, interest and liquidated damages.
